These Terms and Conditions set out the basis on which Elmstead Carpet Cleaners provides domestic and commercial carpet cleaning and related cleaning services in the UK. By making a booking, you agree to be bound by these terms. Please read them carefully before confirming any appointment. If you do not agree with any part of these terms, you should not proceed with a booking.
In these terms, references to we, us and our mean Elmstead Carpet Cleaners. References to you and your mean the customer, whether an individual, business, landlord, tenant, managing agent, or other person requesting the service. These terms apply to all carpet cleaning services, upholstery cleaning, rug cleaning, stain treatment, and any associated work we agree to perform.
Booking process: A booking is usually made once you have accepted a quotation, selected a suitable service date, and provided the necessary details for the work to go ahead. Quotes may be based on the information you provide, including room sizes, floor coverings, access arrangements, and the condition of the items to be cleaned. We reserve the right to revise any estimate if the information supplied was incomplete, inaccurate, or if the scope of work changes before the appointment.
When you book Elmstead carpet cleaners, you are responsible for ensuring that the area is ready for cleaning at the agreed time. This includes moving fragile items, securing pets, and making sure there is reasonable access to water, electricity, and the relevant rooms or premises. If parking restrictions, access limitations, or building rules affect the appointment, you must tell us in advance so we can plan accordingly. Delays caused by restricted access may result in additional charges or rescheduling.
We may confirm bookings by written message, email, or another agreed method. A booking is only binding once it has been accepted by us. We may refuse a booking at our discretion, including where the required cleaning materials are unsuitable, the premises are unsafe, the job is outside our service scope, or the requested work would not be lawful or practical. Where a site visit is needed before confirming the work, any inspection fee will be stated in advance if applicable.
We aim to deliver a professional carpet cleaning service using appropriate methods for the fibres, finishes, and condition of the surfaces. However, not all marks, stains, odours, or wear can be removed completely. We do not guarantee a like-new result. Outcomes depend on the age of the carpet, previous treatment, fibre type, backing, underlay, prior spillages, and other factors beyond our control. Any special expectations must be discussed before the work begins.
Payments: Payment terms will be agreed at the time of booking or before the service begins. Unless stated otherwise, payment is due on completion of the work. We may require a deposit for larger bookings, repeat appointments, commercial contracts, or jobs requiring reserved equipment or scheduled labour. Deposits may be non-refundable where they are used to secure the date and time of the service, unless cancellation rights under these terms apply.
We accept payment methods notified at the time of booking. You must pay all invoices in full and without deduction, set-off, or withholding unless required by law. If payment is not made when due, we may suspend further work, recover reasonable debt collection or administration costs, and charge interest on overdue sums to the extent permitted under the Late Payment of Commercial Debts legislation or other applicable law. Any discounts or promotional offers are valid only for the stated period and are subject to any stated conditions.
Where a quotation is based on estimated time, the final amount may change if the job takes longer due to unexpected conditions, additional requested tasks, or information not disclosed in advance. Additional charges may apply for heavily soiled areas, repeated stain treatment, excessive furniture moving, extra rooms, or return visits required because the agreed preparation was not completed. We will normally explain any likely extra cost before proceeding where reasonably practicable.
Cancellations and rescheduling: If you wish to cancel or change a booking, you should notify us as soon as possible. For consumer customers, any cancellation rights will be dealt with in accordance with applicable UK consumer law, including the Consumer Contracts Regulations where they apply. However, because our services are often scheduled for a specific date, you may lose the right to cancel once work has begun or where you have expressly requested us to attend within the relevant statutory period and lawful exceptions apply.
If you cancel outside any applicable statutory period, or if you reschedule with insufficient notice, we may charge a reasonable cancellation fee to cover reserved labour, travel, materials prepared, or losses directly resulting from the late cancellation. If you are not present at the agreed time, or we cannot access the premises because of your failure to prepare properly, this may be treated as a late cancellation or aborted visit. We will act reasonably in applying any such charge.
You may ask us to postpone the job if circumstances change, but new dates are subject to availability. We are not responsible for missed appointments caused by factors outside our control, including severe weather, traffic disruption, staff illness, equipment failure, or building access problems. In such cases, we will usually offer a new appointment or alternative arrangement rather than charge a cancellation fee, provided the disruption was not caused by you.
Liability and customer responsibilities: We will carry out the service with reasonable care and skill. If we fail to do so, you may have legal rights under the Consumer Rights Act 2015 or other applicable law. Our responsibility is limited to the direct consequences of our breach and does not extend to loss that is not reasonably foreseeable, indirect loss, loss of profit, or business interruption, except where such limitation is not permitted by law.
We are not liable for damage caused by pre-existing faults, hidden defects, age-related deterioration, poor installation, unsuitable materials, colour loss due to prior wear, or adverse reactions of carpets and fabrics to standard cleaning methods. Some items may be more delicate than they appear, and certain stains may become more visible after cleaning due to prior contamination or previous chemical treatment. We will take reasonable care, but cleaning is carried out at your risk where the item has an inherent vulnerability not reasonably detectable before treatment.
You are responsible for informing us of any known issues before work starts, including loose seams, weak dye, shrinkage history, water damage, moth damage, tack strip problems, underlay issues, electrical hazards, or special handling requirements. If you ask us to move furniture or items, you must ensure they are safe to move and that you have authority to do so. We do not accept responsibility for damage caused by unsafe, unstable, or improperly assembled furniture unless caused by our negligence.
Waste regulations and disposal: In carrying out carpet cleaning services, we may generate waste water, removed debris, packaging, disposable cloths, filters, or other residue. We will manage waste in a lawful and responsible manner, in accordance with applicable UK waste regulations, environmental obligations, and local disposal rules where relevant. We will not knowingly dispose of waste in a way that causes pollution, nuisance, or a breach of statutory duty.
You are responsible for disclosing any hazardous substances, biological contamination, sharps, faecal matter, mould infestations, or other special waste conditions before booking. We may refuse or stop work if a property contains materials that require specialist remediation, protective equipment, or licensed disposal not included in the service. Where specialist waste handling is needed, any extra charges, additional precautions, or third-party arrangements will be discussed in advance where possible.
Any items removed from the premises for treatment, temporary drying, or specialist cleaning remain your responsibility unless we agree otherwise in writing. Where waste or residue must be packaged or contained, we may use appropriate materials to avoid leakage or contamination. You must not request that we dispose of items unlawfully, and we reserve the right to decline any instruction that would breach environmental law or waste management requirements. We may suspend the service if the premises are unsafe or unsanitary.
Service exclusions and limitations: The following are examples of matters that may fall outside our standard carpet cleaning service unless specifically agreed in writing: structural repairs, stain guarantees, restoration of burned or torn fibres, mould remediation, pest treatment, permanent odour removal, and work requiring specialist conservation methods. We may also decline to clean items that are too fragile, contaminated, or unsuitable for the available method.
Any advice we provide is given in good faith based on the information available at the time. It should not be treated as a guarantee that a particular result will be achieved. Differences in fibre composition, previous detergents, age, and wear can affect the final appearance. Drying times are approximate only and may vary depending on ventilation, humidity, room temperature, pile density, and the level of soiling. You should avoid walking on damp areas until reasonably dry.
Where we use third-party products, machines, or subcontracted support, we will select them with reasonable care. However, we are not responsible for failures caused by manufacturer defects, misuse by third parties, or incorrect information supplied by you. Any subcontractor used will be bound by obligations consistent with these terms where appropriate, but this does not create a separate contract between you and the subcontractor unless expressly stated.
Complaints and rectification: If you are unhappy with any aspect of the service, you should notify us within a reasonable time after completion. This allows us to inspect the issue and, where appropriate, offer a remedy such as re-cleaning a suitable area or discussing an appropriate adjustment. We do not guarantee rectification where the issue results from normal drying behaviour, pre-existing damage, or circumstances outside our control.
If a complaint is raised, you must allow us a reasonable opportunity to assess the matter before arranging independent treatment or undertaking alterations that could affect evidence. This does not affect any rights you may have under law. Our goal is always to act fairly and to resolve concerns proportionately. A complaint process is not a substitute for legal rights, and nothing in these terms limits rights that cannot lawfully be limited.
Governing law and general provisions: These terms are governed by the laws of England and Wales. If you are resident in Scotland or Northern Ireland, mandatory consumer protections of your local jurisdiction may still apply where relevant. Any dispute arising from these terms or from the provision of our services will be subject to the jurisdiction of the courts of England and Wales, except where the law requires otherwise.
We may update these terms from time to time to reflect changes in law, business practice, or service arrangements. The version in force at the time of your booking will normally apply to that booking unless a change is required by law. If any provision of these terms is found to be unlawful, invalid, or unenforceable, the remaining provisions will continue in full force. No failure by us to enforce a right will count as a waiver of that right.
Nothing in these terms is intended to exclude or restrict any statutory right that cannot legally be excluded, including rights relating to services carried out with reasonable care and skill, rights in relation to misleading statements, or other mandatory consumer protections.
